2. The Essentials in Brief
This website does not use tracking cookies or analytics tools. We process personal data only when you contact us yourself — via WhatsApp, telephone, or the contact form. Should we introduce an analytics tool in the future, this notice will be amended beforehand and, where required, your consent will be obtained.
3. Hosting (Vercel)
This website is hosted by Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, USA. When the website is accessed, Vercel processes technically necessary data (IP address, date and time of access, page accessed, browser and device type) in what are known as server log files. This processing is necessary for the operation and security of the website; the legal basis is Art. 6(1)(f) DSGVO (legitimate interest in secure and stable operation).
Vercel may process data in the USA. This transfer relies on the European Commission's Standard Contractual Clauses (Art. 46(2)(c) DSGVO) and, where applicable, the EU-U.S. Data Privacy Framework.
We have entered into a data processing agreement with Vercel.
4. Contact via WhatsApp
Our primary contact channel for the valuation of your items is WhatsApp (+34 665 164 779). When you write to us via WhatsApp, we process the data you provide: your phone number, your profile name, the content of your messages, and any photos you send. We use this data solely to handle your enquiry — for the valuation, communication, and, where applicable, the completion of a purchase. The legal basis is Art. 6(1)(b) DSGVO (initiation or performance of a contract).
Please note: WhatsApp is a service of Meta Platforms Ireland Ltd. (or WhatsApp Ireland Ltd.), which processes its own data in connection with the service — including communication metadata — and may transfer data to Meta group companies in the USA. We have no influence over this processing. Details can be found in WhatsApp's privacy policy: https://www.whatsapp.com/legal/privacy-policy-eea. If you would rather not use WhatsApp, you can also reach us by phone or by email at general@antiquemilitaria.de.
5. Valuation Form
If you use our valuation form, we process the data provided there — your name, your email address, optionally your phone number, your description of the item, and any photos you upload — to handle your enquiry. The legal basis is Art. 6(1)(b) DSGVO (initiation of a contract). Only the email address is a mandatory field; all other details are optional.
Sending is technically handled via Resend (Resend Inc.), an email delivery service that forwards the enquiry to our inbox. Transmission is encrypted (TLS). Resend may process data in the USA; this transfer relies on the European Commission's Standard Contractual Clauses.
If you select "Callback requested", we use the phone number provided solely to call you back.
6. Retention Period
We store personal data only for as long as necessary to handle your enquiry. Where a purchase is concluded, we retain the contract- and tax-relevant documents in line with statutory retention obligations (generally 6 years under Spanish commercial and tax law; any applicable German obligations remain unaffected). Enquiries that do not lead to a purchase are deleted no later than 12 months after the last contact.
7. Disclosure of Data
Data is disclosed to third parties only where necessary for the transaction (e.g. banks in connection with payment of the purchase price) or where we are legally required to do so. Your data is never sold.
8. Your Rights
Under the DSGVO, you have the right to access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20), and objection to processing carried out on the basis of Art. 6(1)(f) DSGVO (Art. 21). To exercise these rights, simply contact us using the details given above.
You also have the right to lodge a complaint with a data protection supervisory authority — in Spain with the Agencia Española de Protección de Datos (AEPD, www.aepd.es), or with the German supervisory authority responsible for your place of residence.
9. Changes to this Notice
We update this privacy policy whenever the website or the legal situation changes — in particular before introducing analytics or marketing tools. The version published here at any given time applies.
